RETAILER TERMS & CONDITIONS


This document illustrates the necessary conditions to become an authorised retailer for AVALINA LEATHER and is to be read in conjunction with our standard Terms and Conditions, Shipping & Returns and Privacy Policy available through our website www.avalinaleather.com.au.

Commercial Conditions

Retailers with an established retail store may apply for registration to become authorised retailer for AVALINA LEATHER.

If your application is approved, you enter into an agreement with AVALINA LEATHER agreeing that you will not approach any of the AVALINA LEATHER manufacturers, suppliers or other re-sellers in an attempt undermine our pricing, reputation or brand. Legal action will be taken to pursue losses incurred in the event that we become aware of any such behaviour. We highly recommend you consider your decision carefully before entering into this agreement.

AVALINA LEATHER reserves the right to refuse service applications and terminate accounts at our discretion

Prices

Our pricing is in Australian Dollars and includes GST. We reserve the right to change pricing at our discretion and without notice. We reserve the right to change pricing at our discretion and without notice.

Retailers will be offered a base discount when they commence trading with AVALINA LEATHER. There is potential to receive a higher discount based on target levels that set at our discretion and subject to change.

Low Value Imports

Products dispatched from our Italian warehouse that fall into the low value import category will be exempt from GST if the reseller is registered for GST and declares their ABN.

Shipping Costs

Shipping charges are on top of the advertised retail prices and are calculated based of weight and dimensions. Items are dispatched directly from the manufacturer. You will be provided a quote for shipping following the submission of your order.

Orders / Contract of Sale

Orders may be placed online at www.avalinaleather.com.au or in writing via email with your account manager.

The first order must be at least $1,500.00 AUD per manufacturer. There is no minimum for subsequent orders.

Orders should be submitted with “Payment on Invoice” selected as the payment option.

You will receive an email confirmation within a few minutes of ordering. Please note that this will not include shipping charges and GST may need to be adjusted. Your account manager will provide a final invoice within 24 hours. Please check the invoice details carefully as payment will finalise the Contract of Sale.


Payment

Following receipt of the final invoice payment may be made by Electronic Funds Transfer, VISA, MasterCard or PayPal. Credit Card transactions incur a fee of 2.9% and PayPal transactions 2.5%.

All orders must be paid in full prior to any goods being shipped.

Shipping & Delivery

AVALINA LEATHER will organise delivery of the items you order to the address you specify.

Our delivery system keeps track of your purchase during delivery. You will receive a tracking number by email once the items have been dispatched. Your order will normally arrive within 10 working days after you receive an email confirming dispatch.

All transit times shown on the website are approximate and are dependent on the items ordered, the unproblematic processing of the order and the transit conditions at any given time. Express delivery can be arranged upon request.

Drop-shipping

We can arrange for orders to be drop-shipped direct to you customers. An invoice must be submitted with these orders to meet import requirements.

Retailer Pricing

Retailer prices when on-selling must not fall below the retail price advertised on the Tuscany Leather website. These prices are subject to change. In order to maintain Tuscany Leather's brand image and reputation as a supplier of high quality products, sales promotions that discount products below that of Tuscany Leather are not permitted without prior approval from your account manager.

Availability

Please use the availability of products on the website as a guide for retail customers.

If a product you have ordered is not available you will be informed by email as soon as possible.

Orders may be placed for items marked as on backorder. The time frame for delivery on such items is generally 1-4 weeks but our long established relationship with our suppliers and manufacturers ensures our orders are given priority.

Articles and Pictures Online

AVALINA LEATHER is not responsible for the possibility that, because of a specific computer setting or its malfunctioning, the images on the website are slightly different from the original products.

Legitimacy of the Terms and Conditions

If for any reason any part of these Terms and Conditions were to prove inapplicable in relation to any given scenario, the remaining terms and conditions would nevertheless, not be invalidated.

Change to Terms and Conditions

This Agreement may be modified at any time. Any changes will take effect as soon as they have been posted on the site. By purchasing from AVALINA LEATHER, you agree to check this page on occasion to ensure that you accept the latest terms and conditions.

These Retailer Terms and Condition may be updated from time to time and are to be read in conjunction with our General Terms and Conditions, Returns Policy and Privacy Policy.
